These Terms and Conditions apply to services provided by J&Co Services (“J&Co Services”, “we”, “us” or “our”). By accepting a quote, booking a service, requesting that we commence work, or otherwise engaging J&Co Services, you (“the Customer”) agree to these Terms and Conditions.

1. Our Services

J&Co Services provides property maintenance services to residential and commercial customers, including:

  • Lawn mowing and lawn care
  • Garden maintenance
  • Hedge trimming and pruning
  • Weed removal
  • Landscaping and garden improvements
  • Yard clean-ups and clearing
  • Green waste and rubbish removal
  • Gutter and downpipe cleaning
  • Other property maintenance services agreed with the Customer

The exact scope of work will be based on the quote, booking or other written agreement provided for the particular job.

2. Quotes and Pricing

Where possible, J&Co Services will provide a quote or estimate before commencing work.

Quotes are based on the information available to us at the time, including information and photographs supplied by the Customer and the condition of the property that can reasonably be identified.

If the scope or condition of the property is materially different from what was described or visible when the quote was prepared, additional charges may apply.

This may include, for example:

  • significantly heavier or more extensive overgrowth than expected;
  • additional rubbish or green waste;
  • difficult or restricted property access;
  • undisclosed hazards;
  • additional work requested by the Customer; or
  • work that could not reasonably have been anticipated when the quote was provided.

Where reasonably practicable, we will discuss additional work and charges with the Customer before proceeding.

Unless otherwise stated, a quote applies only to the work specifically described in that quote.

3. Bookings

Bookings are subject to availability and are not confirmed until accepted by J&Co Services.

The Customer must provide accurate contact details, property information and any information reasonably required for us to perform the services.

The Customer must notify us of anything that may affect the work or the safety of our team before we arrive.

4. Property Access

The Customer is responsible for ensuring we have safe and reasonable access to all areas required to complete the booked service.

Where appropriate, the Customer does not need to be present while work is being completed, provided suitable access has been arranged.

Before our arrival, customers should:

  • unlock gates or arrange access;
  • ensure pets are safely secured;
  • remove vehicles or other items obstructing the work area;
  • remove fragile or valuable items from the work area; and
  • tell us about any known hazards or access restrictions.

If we cannot access the property or safely complete the work because adequate access has not been provided, the booking may need to be rescheduled and a call-out or cancellation fee may apply where this has been communicated to the Customer.

5. Customer Responsibilities

The Customer must tell J&Co Services about any known conditions that could affect the work, including:

  • underground irrigation;
  • exposed or concealed pipes;
  • electrical cables or equipment;
  • drainage systems;
  • septic systems;
  • fragile landscaping or structures;
  • recently installed turf or plants;
  • unstable structures;
  • hazardous materials;
  • pets or animals; and
  • any other known hazard.

J&Co Services will take reasonable care while performing all services. However, we are not responsible for damage resulting from hazards or property conditions that were concealed, incorrectly identified or not reasonably apparent to us, to the extent permitted by law.

6. Lawn and Garden Services

Results from lawn and garden services can be affected by factors outside our control, including weather, soil condition, existing plant health, pests, disease, irrigation, previous maintenance and ongoing care.

Unless specifically included in the agreed service, general lawn mowing or garden maintenance does not include ongoing responsibility for the health or survival of lawns, plants, trees or gardens.

The Customer should identify any plants, garden areas or other items that require special treatment before work begins.

7. Landscaping

The scope of landscaping work will be determined by the accepted quote.

Where plants, turf, mulch or other materials are supplied, natural variations in colour, size and appearance may occur.

Plant and turf survival can depend on watering, weather, soil conditions and ongoing maintenance after installation. The Customer is responsible for appropriate ongoing care unless maintenance has specifically been included in our service.

8. Gutter Cleaning and Work at Height

Gutter cleaning and related services will only be carried out where J&Co Services considers it reasonably safe to do so.

We may refuse, postpone or modify work where conditions present an unacceptable safety risk, including because of:

  • roof height or pitch;
  • wet or slippery surfaces;
  • damaged or unstable roofing;
  • unsafe access;
  • severe weather; or
  • other site-specific hazards.

Gutter cleaning removes accessible debris from the agreed areas. It does not constitute an inspection, repair or guarantee of the roof, gutters, downpipes, drainage system or waterproofing unless specifically agreed otherwise.

We may notify the Customer if we observe an apparent issue while completing the work, but our service should not be treated as a building, roofing, plumbing or structural inspection.

9. Rubbish and Green Waste Removal

Only waste agreed as part of the booking will be removed.

The Customer must disclose the nature of rubbish requiring removal before the service.

Unless specifically agreed in advance, we do not accept hazardous, regulated or dangerous materials, including asbestos, chemicals, fuels, medical waste or other materials requiring specialised handling or disposal.

Additional charges may apply if the quantity or type of waste is materially different from what was disclosed when the quote was provided.

10. Weather and Unforeseen Conditions

Outdoor services are affected by weather and site conditions.

J&Co Services may postpone or reschedule work where rain, storms, extreme heat, wet ground or other conditions make the work unsafe, impractical or likely to damage the property.

We will endeavour to notify the Customer and arrange another suitable time.

J&Co Services is not responsible for delays caused by weather or circumstances reasonably outside our control.

11. Cancellations and Rescheduling

We understand that plans change.

Customers should provide as much notice as reasonably possible if they need to cancel or reschedule a booking.

Where a cancellation fee applies to a particular service, this will be disclosed to the Customer before or at the time of booking.

J&Co Services may cancel or reschedule a service due to unsafe conditions, weather, equipment failure, illness or other circumstances reasonably outside our control.

12. Recurring Services

Where a Customer books recurring lawn, garden or property maintenance, the agreed frequency will continue until cancelled or changed by either party.

Service timing may vary due to weather, public holidays, seasonal conditions or operational requirements.

If additional work is required because a scheduled service has been skipped, delayed at the Customer’s request, or the property requires substantially more work than would ordinarily be expected under the recurring service, additional charges may apply.

13. Payment

Payment terms will be stated on the relevant quote or invoice.

The Customer agrees to pay invoices by the due date shown.

If an invoice remains unpaid, J&Co Services may suspend future services until outstanding amounts have been paid.

Any reasonable costs incurred in recovering overdue amounts may be payable by the Customer to the extent permitted by law.

14. Changes to the Scope of Work

If the Customer requests additional work while we are on site, we may agree to complete that work subject to time and availability.

Additional work may incur additional charges.

Where practical, these charges will be discussed before the additional work is undertaken.

15. Damage and Existing Property Conditions

J&Co Services will exercise reasonable care and skill when working at the Customer’s property.

The Customer should notify us as soon as reasonably possible if they believe our work has caused damage.

We are not responsible for deterioration, failure or damage caused by pre-existing defects, wear and tear, structural problems or hidden conditions that could not reasonably have been identified before or during the service.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

16. Photos and Job Records

J&Co Services may take photographs of the work area before, during or after a service for job records, quoting, quality assurance and dispute resolution.

We will obtain appropriate permission before using identifiable images of a Customer’s property for promotional or marketing purposes where consent is required.

17. Satisfaction and Service Concerns

We take pride in providing reliable, high-quality property maintenance.

If you have a concern about a service, please contact us as soon as reasonably possible so we can assess the issue and, where appropriate, arrange a suitable resolution.

18. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Where the Australian Consumer Law applies, customers may have rights and remedies where services are not provided with due care and skill, are not fit for an agreed purpose, or are not supplied within a reasonable time where no timeframe has been agreed.

These rights apply in addition to any rights provided under these Terms and Conditions.

19. Limitation of Liability

To the maximum extent permitted by law, J&Co Services will not be liable for indirect or consequential loss arising from circumstances outside our reasonable control.

Nothing in this section or elsewhere in these Terms is intended to exclude or limit any liability, consumer guarantee or remedy that cannot lawfully be excluded or limited under Australian law.

20. Third-Party Contractors

Where reasonably required, J&Co Services may use employees, subcontractors or other suitably qualified service providers to assist in providing services.

J&Co Services remains responsible for its obligations to the Customer as required by applicable law.

21. Changes to These Terms

J&Co Services may update these Terms and Conditions from time to time.

The Terms applying to a particular service will be those provided or made available to the Customer when the service is booked or agreed, unless otherwise agreed between the parties.

22. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia.

The parties submit to the jurisdiction of the courts and tribunals of Queensland and any courts entitled to hear appeals from them.
